精神保健福祉法#入院制度の比較

精神保健福祉法第二十九条による強制入院である。都道府県知事、政令指定都市市長の命令により精神保健指定医二名以上の診察を受けさせ、その者が精神障害者であり、自身を傷つけ又は他人に害を及ぼすおそれがあるという診断が一致すれば、そのものを精神科病院または指定病院に入院させることができる。この際、保護者の同意は不要である。入院期間に制限はなく、退院は医師の判断で可能となる。
緊急措置入院は措置入院と違って精神保健指定医一名の診察のみで入院させることができるが、入院期間は72時間以内に制限される。

精神保健福祉法第二十九条

都道府県知事は、第二十七条の規定による診察の結果、その診察を受けた者が精神障害者であり、かつ、医療及び保護のために入院させなければその精神障害のために自身を傷つけ又は他人に害を及ぼすおそれがあると認めたときは、その者を国等の設置した精神科病院又は指定病院に入院させることができる。
２前項の場合において都道府県知事がその者を入院させるには、その指定する二人以上の指定医の診察を経て、その者が精神障害者であり、かつ、医療及び保護のために入院させなければその精神障害のために自身を傷つけ又は他人に害を及ぼすおそれがあると認めることについて、各指定医の診察の結果が一致した場合でなければならない。
